Assumption of Risk Agreement

 

This Assumption of Risk Agreement ("Agreement") is made effective as of the date and time of entry into the HangCon event and is a legal binding agreement between HangCon LLC & its organizers, Aubrey Glenn & Paul Collins, located at 85 Myers Rd, Brooksville, FL 34602, and the participant coming to HangCon.

 

1. Event Description

 

Participant acknowledges and agrees to participate in HangCon, an outdoor hammock festival organized by Aubrey Glenn & Paul Collins, HangCon LLC at their own free will.

 

2. Acknowledgment of Risks

 

Participant acknowledges that participation in HangCon involves certain risks and dangers, including but not limited to:

• Environmental Risks: Exposure to outdoor elements, weather conditions, and natural terrain.

• Physical Activity: Participation in physical activities such as walking, standing, and potential recreational activities.

• Equipment and Structures: Use of temporary structures, equipment, and facilities.

Participant understands that these risks and dangers may result in personal injury, illness, death, property damage, or other loss, and voluntarily assumes all such risks.

 

3. Release and Waiver

 

Participant hereby releases, waives, discharges, and covenants not to sue HangCon LLC, its officers, directors, employees, agents, and representatives from any and all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating to Participant’s participation in HangCon, including but not limited to personal injury, illness, death, property damage, or loss.

 

4. Indemnification

 

Participant agrees to indemnify and hold harmless HangCon LLC and its organizers, Aubrey Glenn & Paul Collins from any loss, liability, damage, or cost, including attorney fees, arising out of or related to Participant’s participation in HangCon or any breach of this Agreement.

 

5. Representation of Legal Age and Authority

 

Participant represents that they are of legal age and have the authority to enter into this Agreement. If Participant is registering on behalf of a minor or someone lacking legal capacity, Participant agrees to indemnify and hold harmless HangCon LLC and its organizers, Aubrey Glenn & Paul Collins from any claims brought by or on behalf of such minor or incapacitated person.

 

6. Governing Law

 

This Agreement shall be governed by and construed in accordance with the laws of Florida in the United States of America.

 

7. Severability

 

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

 

8. Entire Agreement

 

This Agreement constitutes the entire agreement between Participant and HangCon LLC concerning the subject matter hereof, and supersedes all prior agreements and understandings, whether written or oral.
